These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "User," "you") and Supen Spa ("Company," "we," "us," "our"), governing your access to and use of our website, services, facilities, and all related offerings. By booking, accessing, or using any service, you irrevocably agree to be bound by these Terms in their entirety.

1. Eligibility & Consent

You must be at least 18 years of age to use our services. By booking any appointment, you represent and warrant that you are of legal age and have the legal capacity to enter into binding agreements. All clients must complete a health intake form prior to their first session. By doing so, you consent to receive the chosen treatment and acknowledge all associated risks.

2. Booking & Appointments

All bookings are subject to availability and confirmation. We reserve the right to refuse service to any individual at our sole discretion without providing a reason. Bookings made via WhatsApp, phone, or the website constitute an agreement to these Terms. Appointments are considered confirmed only upon explicit confirmation from our team.

3. Cancellation & No-Show Policy

Cancellations must be communicated at least 4 hours prior to the scheduled appointment time. Late cancellations or no-shows may result in forfeiture of any prepaid amount or membership credits. We reserve the right to charge up to 100% of the service fee for no-shows.

4. Health Disclosure & Assumption of Risk

You are solely responsible for disclosing all relevant health conditions, allergies, injuries, medications, pregnancies, and any other medical information that may affect your treatment. Failure to disclose accurate health information releases Supen Spa from all liability. You expressly assume all risks associated with the use of our services, including but not limited to allergic reactions, skin irritation, bruising, soreness, dizziness, or any other physical or emotional response.

5. Personal Belongings & Valuables

Supen Spa is NOT responsible for any loss, theft, damage, or destruction of personal belongings, valuables, electronics, jewelry, or any other items brought to our premises. Clients are advised to leave valuables at home or in their vehicles.

6. Conduct & Behavior

Supen Spa maintains a zero-tolerance policy for any inappropriate, abusive, threatening, or disrespectful behavior toward our staff. Any such conduct will result in immediate termination of the service without refund, permanent ban from our premises, and potential legal action.

7. Photography & Recording

Photography, video recording, or any form of audio-visual recording within our premises is strictly prohibited without prior written consent from management. Violation may result in confiscation of recording devices and legal action.

8. Intellectual Property

All content, branding, methodologies, treatment protocols, and proprietary techniques used by Supen Spa are our exclusive intellectual property. Reproduction, imitation, or unauthorized use is strictly prohibited.

9. Membership Terms

Membership packages are non-transferable (unless explicitly stated), non-refundable after activation, and valid only for the specified duration. Unused sessions within the validity period shall expire without compensation. Membership benefits cannot be combined with other offers unless explicitly authorized. We reserve the right to modify membership terms, pricing, and benefits at any time.

10. Limitation of Liability

Under no circumstances shall Supen Spa, its owners, directors, employees, therapists, agents, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of our services, facilities, or website. Our total cumulative liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

11. Indemnification

You agree to fully indemnify and hold harmless Supen Spa and its affiliates from all claims, damages, losses, liabilities, costs, and expenses arising from your use of our services, breach of these Terms, or violation of any applicable law or third-party rights.

12. Governing Law

These Terms shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

13. Amendments

We reserve the right to modify these Terms at any time. Continued use of our services after modifications constitutes acceptance. It is your responsibility to review these Terms periodically.
